My husband was down to the end of the game. Dryad and Human each had one planet left. Talon popped up and wiped them both out. The lose timer started ticking. Rather than negotiate, my husband destroyed Talon and became the sole survivor.

Diplomatic Win! And the lose timer kept ticking.

This is not a bug.

It's just missing a corresponding achievement with a suitable title such as "Scorched Earth Diplomacy".
